More people than ever before are getting prescriptions, which means that pharmacies in Texas and across this nation are busier than ever before. Unfortunately, what this means is that there is a chance for more pharmacy errors to take place. Sadly, any mistake at the pharmacy can cause serious injuries and even death to patients. But the truth is that mistakes shouldn’t be occurring. Pharmacists are trained professionals that have to abide by a duty of care in filling prescriptions, which means that prescriptions should be filled accurately.

However, the reason there are pharmacy malpractice lawsuits is because pharmacists sometimes make critical mistakes with medicines. When pharmacists are careless and negligent, they may fill an incorrect dosage of drugs, the wrong medication, or provide the wrong instructions. If any of these mistakes occur, patients can suffer harm. As a result, a pharmacist may have breached or violated their duty of care.

If a breach of that duty caused harm to a patient, a patient may file a pharmacy malpractice lawsuit to collect damages. The reason someone has a right to purse compensation when injuries occur as a result of a pharmacy error is because pharmacists are skilled professionals who are responsible for every prescription that occurs on their watch. When a prescription mistake occurs, it can be assumed that the pharmacist on duty did not provide reasonable care for the patient and, thus, breached his or her duty of care.

If you believe you have been a victim of pharmacy malpractice, you may be due damages, such as medical expenses, loss of earnings, pain and suffering and more. A skilled lawyer who knows how to investigate these types of cases can help you hold the negligent pharmacist and pharmacy liable for your injuries and losses.
