Q: How long do I have to file a prescription error lawsuit?

The laws vary from state to state.

  • In Texas, you have two years from the date you would have reasonably known you were injured by the pharmacy's medication error. If the injured patient is a child under the age of 12, they have until their 14th birthday to file or have the case filed on their behalf.

Other states have slightly different statutes of limitation for pharmacy malpractice claims. If you have questions about the laws in your state you can contact our office 24/7 to have an attorney review the particular facts of your case.
